Host/Hostess Liability (N.J.S.A. 2A:15-5.6)

A host or hostess who provides alcoholic beverages to a visibly intoxicated guest can be held liable for injuries inflicted on a third party if that guest is involved in a motor vehicle accident.

The reader is strongly encouraged to maintain familiarity with any changes because current laws may be revised and/or new laws established following publication of this bulletin. At this time, there are several bills regarding various aspects of alcohol use that are pending approval in the state legislature.

For further information about these laws, about alcohol in general, or the effects of alcohol- related problems, contact the Alcohol and Other Drug Education and Training Program of the Department of Health Education at (908) 932-7710.
