The following is a PowerPoint to support Plaintiff's Closing statement in a seven week racial discrimination and whistle blowing trial, Newman v. Ramapo College. Professor Sullivan assisted lead counsel, Professor Mark P. Denbeaux, in trying the case, which was unsuccessful. The following is a video clip that circulated over the internet a few years ago. Accordingly, no warranties are made regarding intellectual property. In 2004, Seton Hall University instituted an on-line sexual harassment training program for, inter alia, faculty members. Consider having your students take the training, and then ask them whether the existence of the on-line program (presumably coupled with a monitoring device to see who took it (or clicked on it?) would satisfy the "prevent" portion of an employer's affirmative defense. 06/22/2004 Web Link
Researchers at Harvard, Virginia and the University of Washington have developed a series of tests that purport to reveal our "automatic preferences" in various respects, including race and color.
